What is a Lasting Power of Attorney?
A Lasting Power of Attorney is a legal document that lets you choose someone you trust to make decisions on your behalf, if you’re ever unable to do so yourself.
The person you choose is called your attorney. This could be a solicitor, a family member, friend, partner or even us at Enable and Thrive!
Why might I need one?
There are many reasons why someone might lose the ability to make decisions - a serious accident, a stroke, or conditions like dementia.
Having an LPA in place gives peace of mind and saves money in the long run! It means if something happens, your chosen person can step in and act in your best interests.
Without an LPA, your loved ones might have to go through a lengthy and costly court process just to help you manage everyday things like bills or healthcare decisions.
Are there different types of LPA?
Yes, there are two types of Lasting Power of Attorney:
Health and Welfare LPA
This allows your attorney to make decisions about your medical care, daily routine, where you live, and even refusing or accepting consent to life-sustaining treatment. This is only if you are unable to make those decisions yourself.
Property and Finance LPA
This lets your attorney manage your finances, such as paying bills, managing bank account, and selling your property. You can choose for this type to be used as soon as it’s registered, even if you still have capacity, which can be helpful if you are unwell or away.
Who should I choose as my attorney?
This is a big decision. Your attorney should be someone you trust completely, who knows your wishes and will act in your best interests. You can also choose more than one person if you like, or even a company for Property and Finance LPA only. If you have no one to support you, this is where we can help as a solicitor-led company.
How do I set up a Lasting Power of Attorney?
If you wish to appoint Enable and Thrive, simply give us a call and we will guide you through our referral process.
In any other case, head to the Office of the Public Guardian website, where you will find the LPA documents. You’ll need to:
Fill in the forms, either online or print them off
Get them signed and witnessed
Post them to the Office of the Public Guardian for registration
