A Lasting Power of Attorney (LPA) is meant to protect - not harm. Sadly, in some cases, an Attorney misuses that power. When this happens, legal action may be necessary to step in and protect the person at risk.

What counts as abuse?

Abuse by an attorney can include:

  • Stealing money or using funds for personal gain

  • Making decisions that aren’t in the person’s best interests

  • Neglecting their duties or failing to act at all

  • Manipulating or isolating the person they’re meant to protect

  • Unnecessary restriction of that person’s freedom

This can happen under both Health and Welfare as well as Property and Finance LPAs.

Taking legal action

If abuse is suspected, it’s important to act. Steps include:

  1. Reporting concerns to the Office of the Public Guardian (OPG)

  2. Applying to the Court of Protection to remove or replace the attorney

  3. Seeking professional advice from a trusted organisation, such as us at Enable and Thrive

In serious cases, the attorney could face criminal investigation or civil proceedings.
